Overview

"We," "us," and "our" refer to Fiber Content Co. We operate this store and website, including all related content, features, tools, and products (the "Services"). The store runs on Shopify.

These Terms of Service, together with the policies referenced in them, describe your rights and responsibilities when you use the Services. Read them carefully. They include important provisions about warranties and about the limits of our liability.

By visiting or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. Access and accounts

By using the Services you confirm that you are at least the age of majority where you live, and that you consent to any minor dependents using the Services on devices you control.

You may be asked to provide information such as your email address and billing and shipping details. You confirm that the information you give us is accurate, current, and complete, and that you have the right to provide it.

You are responsible for keeping your account credentials secure and for activity on your account. You may not transfer, sell, or assign your account to anyone else.

2. Our products

Most of our shirts are printed to order on Comfort Colors 1717, a 100% ring spun US cotton, 6.1 ounce, garment dyed blank.

Garment dyeing produces variation. Shade differs slightly from piece to piece and from dye lot to dye lot, and that variation is a property of the process rather than a defect. Screen printed color and garment color will also appear differently on your screen than in person depending on your display and its settings.

We do not warrant that a product's appearance will match how it looked on your screen. Product descriptions, availability, and pricing may change at any time without notice, and we may discontinue any product or limit quantities at our discretion.

3. Orders

Placing an order is an offer to buy. We may accept or decline any order at our discretion, and your order is not accepted until we confirm it and process payment. Because items enter production quickly, we may be unable to accommodate changes or cancellations after acceptance. If we decline, change, or cancel an order, we will attempt to reach you using the contact details you provided.

Returns and exchanges are governed solely by our Refund Policy.

Purchases are for personal or household use, not for commercial resale or export.

4. Prices and billing

Prices, discounts, and promotions may change without notice. The price that applies is the one in effect when you place your order, as shown in your confirmation email. Posted prices exclude taxes, shipping, and any customs or import charges unless we state otherwise.

Promotions may carry their own terms, which govern where they conflict with these Terms. Discount codes are single use per customer unless stated otherwise and may not be combined.

You agree to provide accurate and current payment information, to keep it updated, and to pay all charges you incur, including shipping and applicable taxes. You confirm that you are authorized to use the payment method you provide.

5. Shipping and delivery

Delivery times are estimates and are not guaranteed. We are not liable for delays caused by carriers, customs, weather, or other events outside our control. Title and risk of loss pass to you when we hand the goods to the carrier. Our Shipping Policy covers the details.

6. Intellectual property

Buying a shirt gives you a shirt. It does not transfer any rights in the artwork printed on it. You may not reproduce our designs on other goods, whether for sale or otherwise.

7. Photographs, reviews, and other submissions

If you send us photographs, reviews, feedback, suggestions, or other content, or tag us publicly on social media, you grant us a worldwide, royalty free, sublicensable license to use, reproduce, adapt, publish, and display that content in any medium, including in marketing.

If we plan to feature your photograph prominently, we will ask first as a matter of courtesy. That is our practice, not a legal obligation you can hold us to, and this section is what governs.

You confirm that you own or have the rights to anything you submit, that you have disclosed any compensation you received in connection with it, and that it does not infringe anyone's rights or contain unlawful, abusive, or malicious content. We are not obliged to keep submissions confidential, to pay for them, or to respond to them, and we may remove any submission at our discretion.

8. Third party tools and links

The Services may include tools, embedded features, or links provided by third parties. We provide access to these as is, without warranties or endorsement, and we are not responsible for their content, accuracy, or your dealings with them. Review their terms before using them. Direct any complaint about a third party's product or service to that third party.

9. Relationship with Shopify

Our store runs on Shopify, but every sale is made directly with Fiber Content Co. Shopify is not responsible for any aspect of a sale between you and us, including any injury, damage, or loss arising from a product. You release Shopify and its affiliates from claims arising out of your transactions with us.

10. Privacy

Personal information collected through the Services is governed by our Privacy Policy, and some of it is additionally subject to Shopify's own privacy terms. By using the Services you confirm that you have read our Privacy Policy.

11. Errors and omissions

The Services may occasionally contain typographical errors or inaccuracies relating to descriptions, pricing, promotions, shipping charges, transit times, or availability. We may correct errors and may change information or cancel an order affected by an error at any time without prior notice, including after you have submitted it.

12. Prohibited uses

You may use the Services only for lawful purposes. You may not use them to break any law, infringe anyone's intellectual property, harass or abuse anyone, transmit false or misleading information, send spam, impersonate anyone, upload malicious code, scrape or crawl the site, collect other people's information, resell any part of the Services, or interfere with the site's security. We may suspend or terminate access at any time if we determine that you have violated these Terms.

13. Termination

We may terminate this agreement or your access to the Services at our discretion and without notice. You remain liable for amounts owed up to the date of termination. The sections covering intellectual property, submissions, termination, disclaimers, limitation of liability, indemnification, severability, waiver, assignment, governing law, and privacy survive termination, along with any other provision that by its nature should.

14. Disclaimer of warranties

Information on the Services is provided for general purposes only. We do not warrant that it is accurate, complete, or useful, and any reliance you place on it is at your own risk.

EXCEPT AS EXPRESSLY STATED BY FIBER CONTENT CO., THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THEM ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON INFRINGEMENT. WE DO NOT WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE. SOME JURISDICTIONS DO NOT ALLOW THESE DISCLAIMERS, SO THEY MAY NOT APPLY TO YOU.

15. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FIBER CONTENT CO., ITS OWNERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS, AND THOSE OF SHOPIFY, SHALL NOT BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR REPLACEMENT COSTS, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT PURCHASED THROUGH THEM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY. WHERE LIABILITY CANNOT BE EXCLUDED, IT IS LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

16. Indemnification

You agree to indemnify and hold harmless Fiber Content Co., Shopify, and our affiliates, officers, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable legal fees, arising out of your breach of these Terms, your violation of any law or third party right, or your use of the Services.

17. Severability

If any provision of these Terms is found unlawful or unenforceable, it will be enforced to the greatest extent permitted and otherwise severed, and the remaining provisions stay in effect.

18. Waiver and entire agreement

Our failure to enforce any provision is not a waiver of it. These Terms, together with the policies posted on this site, are the entire agreement between you and us regarding the Services and supersede any earlier agreements or versions. Ambiguities will not be construed against either party as drafter.

19. Assignment

You may not assign or transfer these Terms or your rights under them without our written consent. We may assign or transfer them without notice.

20. Governing law

These Terms are governed by the laws of the State of NY, without regard to conflict of law principles. You and Fiber Content Co. consent to the jurisdiction and venue of the state and federal courts located there.

21. Headings

Headings are for convenience only and do not affect the meaning of these Terms.

22. Changes to these Terms

The current version is always posted on this page. We may update or replace any part of these Terms by posting changes here, and it is your responsibility to check periodically. Material changes will be notified as required by law. Continuing to use the Services after changes are posted means you accept them.
